Article 1 – Purpose and Scope

1.1 Definition of the Patient Terms of Use
These General Terms of Use (hereinafter the “Terms”) define the rules applicable to the use of the The Tongue Teacher mobile application by patients.

1.2 Distinction from the Privacy Policy
These Terms govern the conditions of use of the application. They are supplemented by the Patient Privacy Policy, which describes how personal data is managed.

1.3 Acceptance of the Terms
Use of the application is subject to full and unconditional acceptance of these Terms.
This acceptance is materialized by a checkbox at the launch of the application. Without acceptance, access to and use of the application are not possible.

1.4 Intended Users
The Terms apply to adult patients and, in the case of minor patients, to their legal representatives.


Article 2 – Access to Services

2.1 Creation of a Patient Account
The patient account is created by the practitioner, who may directly invite the patient or their legal representative.

2.2 Login Credentials and Security
The patient or their legal representative is responsible for maintaining the confidentiality of their login credentials. Any fraudulent use must be reported immediately to The Tongue Teacher SAS.

2.3 Access for Minors
Access for minors is under the responsibility of the parent or legal representative, who must supervise the use of the application and consent choices.

2.4 Technical Requirements
Access to the application requires a compatible smartphone and an Internet connection. Costs related to equipment and connection remain the responsibility of the patient.


Article 3 – Use of the Application

3.1 Educational Purpose
The application is intended to support the rehabilitation program prescribed by the practitioner. It does not constitute a medical device and does not provide any automatic diagnosis.

3.2 Compliance with Instructions
The patient or their legal representative agrees to use the application in accordance with the instructions provided by the practitioner.

3.3 Personal Use
The application is intended for strictly personal use and may not be shared with third parties.

3.4 Restrictions
It is prohibited to use the application for fraudulent, abusive purposes, or for purposes unrelated to rehabilitation follow-up.


Article 4 – Entered Data and Generated Content

4.1 Self-Assessments
The patient completes questionnaires and self-assessments in good faith.

4.2 Completed Exercises
The application allows certain prescribed exercises to be performed and recorded.

4.3 Submission of Photos and Videos
When a photo or video is taken via the application, a pop-up clearly informs the user whether the file will be transmitted to the practitioner.
The patient or their legal representative must explicitly validate the submission.

4.4 Refusal of Transmission
The patient may refuse to send a photo or video. In such case, the practitioner is informed, but the absence of transmission does not prevent continuation of the program.

4.5 Deletion After Transmission
The patient may delete a photo or video already transmitted via the application settings. Deletion also results in its removal on the practitioner’s side, with notification.

4.6 Reference to the Privacy Policy
The conditions for the collection, use, retention, and deletion of personal data (including photos and videos) are detailed in the Patient Privacy Policy, accessible at any time from the application.


Article 5 – Patient Obligations

5.1 Diligence
The patient agrees to use the application regularly, in accordance with the program defined by the practitioner.

5.2 Accurate Information
The responses provided in self-assessments must be truthful and accurate.

5.3 Consent
The patient or their legal representative agrees to comply with the consent rules for photos and videos, as described in the Privacy Policy.

5.4 Respect of Parental Authority
For minors aged 15 or over, consent is collected from the minor and confirmed by their legal representative.

5.5 Responsibility for Content
The adult patient, or the legal representative of a minor patient, is responsible for the content transmitted via the application (photos, videos, responses).
They agree not to send any content that:
– is unrelated to their rehabilitation;
– is inappropriate or offensive in nature (nudity, violent statements or gestures, degrading content);
– includes third parties who have not given their consent;
– or violates applicable laws and regulations.

Any abusive or unlawful content submission may result in deletion of the patient account, as well as civil and/or criminal proceedings.


Article 6 – Liability

6.1 Role of the Practitioner
The practitioner prescribes the program and monitors the patient’s progress. They remain responsible for therapeutic follow-up.

6.2 Role of The Tongue Teacher SAS
The Tongue Teacher SAS acts as a technical data processor, ensuring hosting and proper functioning of the application.

6.3 Limitation of Liability of The Tongue Teacher SAS
The Tongue Teacher SAS shall not be liable for:
– temporary service interruptions (maintenance, updates, technical incidents);
– non-compliant use of the application by the patient;
– content transmitted by patients.

6.4 No Medical Guarantee
The application is an educational tool. It does not replace a medical diagnosis or treatment provided by the practitioner under any circumstances.


Article 7 – Suspension and Termination

7.1 End of Access
The patient’s access to the application ends in the event of program termination or termination decided by the practitioner.

7.2 Deletion of the Patient Account
The adult patient or the legal representative of a minor patient may request deletion of the account at any time, through the practitioner.

7.3 Consequences of Deletion
Deletion results in loss of access to the application. Data are archived in accordance with the Patient Privacy Policy.


Article 8 – User Support

8.1 Available Channels
Support is available at the following address: support@tongueteacher.com, or through the practitioner.

8.2 No Guaranteed SLA
No guaranteed response time is provided. However, The Tongue Teacher SAS undertakes to respond within a reasonable timeframe.


Article 9 – Amendments to the Terms

9.1 Right to Modify
The Tongue Teacher SAS may modify these Terms at any time.

9.2 Notification
Any substantial modification will be notified via the application or by any other appropriate means.

9.3 Entry into Force
Continued use of the application after modification constitutes acceptance of the updated Terms.


Article 10 – Duration and Termination

0.1 Applicability
These Terms apply for as long as the patient account remains active.

10.2 End of Follow-Up
The Terms automatically cease at the end of the follow-up prescribed by the practitioner.

10.3 Effects of Termination
End of use results in loss of access. Data remain archived in accordance with the Patient Privacy Policy.


Article 11 – Governing Law and Jurisdiction

11.1 Governing Law
These Terms are governed by French law.

11.2 Competent Jurisdiction
Any dispute relating to these Terms shall fall under the jurisdiction of the French courts.


Article 12 – Miscellaneous Provisions

12.1 Severability
If any clause is declared invalid, the remaining clauses shall remain applicable.

12.2 No Waiver
The failure of The Tongue Teacher SAS to enforce any clause shall not constitute a waiver.

12.3 Electronic Evidence and Communication
The patient acknowledges that electronic records and notifications made by The Tongue Teacher SAS constitute admissible evidence.
